Scope and effectiveness of the General Terms and Conditions

These general terms and conditions of sale (hereinafter, the “General Terms”) govern the purchase of products made remotely and made available via the internet on the website www.tartufobianco.com (hereinafter, the “Website”) in compliance with Italian legislation, namely Legislative Decree 206/2005 as amended and supplemented (hereinafter, the “Consumer Code”).

The consumer who accesses the Website to make purchases (hereinafter, the “Customer”) is required, before submitting the order, to carefully read these General Terms, which have been made available to them on the Website and can be accessed by the Customer at any time, including via the link contained in the confirmation email for each order, to enable them to print and save a copy.

If the person making purchases on the Website requests an invoice and/or is not a “consumer or user” as defined in Article 3, paragraph 1, letter a), of the Consumer Code, the provisions on Refund & Return Policy under Articles 7 and 8 of these General Terms, and more generally any provisions of the Consumer Code applicable solely to “consumers,” shall not apply.

Contracts concluded with TartufoBianco through the Website are governed by these General Terms in compliance with Italian legislation. The language available for concluding the contract is Italian

Select and Order Products

The features and price of the various products for sale on the Website (hereinafter “Product” or “Products”) are set out on the page relating to each Product.

To purchase the Products, the Customer must complete and submit the order form in electronic format, following the instructions provided on the Website. The Customer must add the Product to the “Cart” and, after reviewing and confirming acceptance of the General Terms and Conditions and the Privacy Policy, enter the shipping and, if applicable, billing details, select the desired payment method and confirm the order.

By submitting the order from the Website, which constitutes a contractual offer, the Customer acknowledges and declares that they have reviewed all the information provided to them during the purchase process and fully accept these General Terms and Conditions and the payment terms set out herein.

The contract entered into between TartufoBianco.com and the Customer shall be deemed concluded upon acceptance of the order by TartufoBianco.com. Such acceptance will be communicated to the Customer by way of an order confirmation email containing a link to these General Terms and Conditions, the order number, the shipping and billing details, a list of the Products ordered with their essential features and the total price, including delivery costs. The Customer must check the confirmation email and, should they identify any errors in the order, will have 12 hours from receipt of such email to contact Customer Service directly from the Website using the appropriate contact form accessible via the “Contacts” tab. After this period, the order will be processed for shipping and no further changes will be accepted, without prejudice to the Customer’s rights under the following Article 7.

Upon receipt of the order, TartufoBianco.com will check stock availability for the fulfillment of the order. In the event that one or more Products are not available, Customer Service will promptly notify the Customer by email, who, within the following 12 hours, will have the option to respond to confirm the shipping of any additional available Products or to cancel the order. In the event of no response within this period, the order will be considered confirmed and the available Products will be shipped. In such case, the full amount relating to the missing Products will be reversed or, in any event, depending on the chosen payment method, will not be charged to the Customer.

Product Information

Information and specifications relating to the Products, along with their respective Product codes, are available on the Website.

Where available, the visual representation of the Products on the Website normally corresponds to the photograph accompanying the product description. It is understood that the image of the Products is intended solely to present them for sale and may not perfectly represent their characteristics and qualities, and may differ in colour and size. In the event of any discrepancy between the image and the written product description, the product description shall always prevail.

Prices and shipping

Product prices include all taxes and duties. All prices are in Euros. Fresh product prices are often subject to unpredictable variations, and prices may fluctuate upwards or downwards. For this reason, we do not accept pre-orders, as we would be unable to set the price in advance. Shipping costs vary depending on the total weight of the products purchased and the final delivery destination. On the Cart page, and later on the Checkout page, users will be able to view the actual shipping cost (including the delivery destination) before confirming their order.

Deliveries are made throughout the EU.

Shipping within Italy:

Shipments within Italy are delivered by express courier.

International Shipping:

Shipments outside Italy but within the EU are delivered by express courier

Shipping Times

Delivery times are calculated from the day after the order is placed, according to the following timeframes:

24–72 business hours for Italy and international destinations
24–96 business hours for Sicily, Calabria, and Sardinia

Payment and billing methods

Payment methods
The Customer may pay the price of the Products and the related delivery costs by PayPal, bank transfer and cash on delivery.

PayPal/Credit Card

Once the order has been confirmed, the Customer may pay directly with their PayPal account or use a credit card, including a prepaid card, or otherwise according to the methods accepted by PayPal and in compliance with its terms and conditions.

Order Invoicing

If the purchase is made by a professional, an invoice may be requested by selecting the appropriate box during the ordering process and entering the billing details, including the tax code and/or VAT number. In such cases, the invoice will be sent by email to the address provided. The professional is responsible for entering the billing details correctly and is expressly informed that, if an invoice is not requested at the time of ordering, it cannot be requested afterwards.

Shipping and delivery

Products purchased on the website will be delivered to the address provided by the Customer during the purchase process in the appropriate “Shipping Details” field.

All purchases will be delivered by express courier (hereinafter, the “Courier”) from Monday to Friday, excluding weekends and public holidays.

TartufoBianco.com is not responsible for delays that are unforeseeable or not attributable to it.

Once the Products have been shipped, the Customer will receive a confirmation email containing a link for tracking the shipment.

In any case, except in cases of force majeure or accidents, the ordered Products will be delivered within a maximum period of 5 (five) business days starting from the business day following the day on which TartufoBianco.com confirmed the order to the Customer via the appropriate order confirmation email. All shipments will be processed on the business day following the day the order was placed, provided it was placed before 8:00 p.m.

*Shipping within Italy is free for orders over €199, except for orders of products that were already discounted at the source.

Errors and limitations of liability

The Product information provided through the Website is constantly updated. However, it is not possible to guarantee the complete absence of errors, and therefore TartufoBianco.com cannot be held responsible, except in cases of willful misconduct or gross negligence.

TartufoBianco.com reserves the right to correct errors, inaccuracies, or omissions even after an order has been sent, or to modify or update the information at any time without prior notice, without prejudice to the Customer's rights under these General Terms and Conditions and the Consumer Code.

Except in cases of willful misconduct or gross negligence, any right of the Customer to compensation for damages or to recognition of an indemnity is excluded, as is any contractual or non-contractual liability for direct or indirect damage to persons and/or property caused by the failure to accept or process, even partially, an order.

TartufoBianco.com promotes the responsible consumption of alcohol and excludes any liability on its part, except in cases of willful misconduct or gross negligence, in the event of a purchase made by minors under 16 years of age.

Governing law and jurisdiction

The contract of sale between the Customer and TartufoBianco.com is deemed to be concluded in Italy and governed by Italian Law. For the resolution of disputes relating to the interpretation, performance or termination of these General Terms and Conditions or individual purchase orders, if the Customer is a consumer within the meaning of the Consumer Code, the courts of their municipality of residence or domicile shall have exclusive jurisdiction if located in Italian territory; in all other cases, the courts of Spoleto shall have exclusive jurisdiction, to the exclusion of any other competent court.

Pursuant to Article 1341 of the Italian Civil Code, the Customer declares that they have read and specifically accept the following articles of these General Terms and Conditions: 6 (liability for delays in delivery), 8 (right to correct errors – exclusions of liability).
